Many people put off thinking about and establising a will. It is always preferrable to have a will because this puts in place a clear legal document to determine how your property (estate) is handled after your death. With a will you determines who will be the "executor" or "excutrix" of the will. This person works with an attorney to collect, administer, and distribute the estate. The attorney then files a probabte petition with the court to empower the executor (or executrix) to transfer property, stock etc. to persons named in the will.

Many New York state lawyers who specialize in estate planning also handle living wills and health care proxies. A Living Will formally states how you want your health care treatment to be handled if you become mentally or physically incapable of expressing your desires. More issues than life support can be addressed in a living will. A Health Proxy is a document that enables you to designate a person to make health care treament decisions for you if you cannot do so.
